    HR Issues Post-Election: Preparing for the Challenges Ahead
     
    Tuesday, November 6 marks the end of a long, tumultuous election campaign.  At the end of the day, we’ll know which presidential candidate will lead our nation for the next four years and the outcome of state propositions impacting education and other public policy issues.  While we may be breathing a collective sigh of relief now that the partisan ads and debates are finally over, there is little time to sit back and wait. What’s next for our organizations and our 2013 to-do lists?
     
    Our speaker, attorney Ray Hixson of Hixson Nagatani LLP, will discuss how the November elections may affect federal enforcement initiatives and other new developments. He will also bring us up to speed on new California and federal rulings that will impact how we do business in 2013:
     
    • Looming Deadline Regarding Commission Pay:  learn what all California employers are required to do to meet the January 1, 2013 deadline to document commission pay terms in signed, written agreements.
    • Social Media:  learn about California’s ban on employers obtaining access to employee social media, including the surprisingly broad definition of “social media” and exceptions to the ban.
    • Disability Accommodation:  a new court ruling that requires transfer of a disabled applicant to a vacant position absent undue hardship (even when there is a more qualified candidate), and a court’s finding that an employer may have violated the ADA by demanding that an employee attend psychological counseling.
    • Investigations:  the NLRB’s ruling that an employer unlawfully restricted employees from discussing internal complaints in the context of an employer investigation.

    • Registrations after the advance registration deadline are subject to space availability. Cancellations after the advance registration deadline may be eligible for a credit towards the next program. No-shows are not eligible for refund or credit. Please be sure your guests are aware of this policy. Walk-ins (only when space is available) without a reservation must pay by check or cash at the door. An additional $5 fee applies to walk-ins.
